nightworker sunday query

I work nights in a shop and opted out of working sundays. I work a monday to friday night shift pattern. My employer is trying to make me work saturday night which would mean finishing at 6.30am on sunday morning.

As I have opted out of working sundays, can I legally refuse to work a saturday night based on the fact that 2/3rds of the shift would be on a sunday?

I doubt it as well. In one of my jobs I start at 9pm and finish at 1am - but they don't count 12am till 1am as the day after as the shift started the day before.

Normally when we talk about shifts, the day starts with the morning shift, that is at 8:00AM and ends with the third shift which is 00:00 to 8:00. Now if you are asked to work on Saturdays you will have to work on Sunday from 00:00 to 8:00AM.

But it depends on your contract with your employer, I don't think that you can refuse to work.

If you work from Monday to Friday means you report duty on Monday 00:00 to 8:00 ( means you start working on Tuesday not Monday I could have clarified it well if you've specified how many hours for a week you've been asked to work?

You may ask an employment law solicitor, but you likely don't have a leg to stand on. Is this a big big company? If so, they have already made you sign everything you need to sign

I used to work nights and only 1 hour of my shift was on a Saturday, but It was still classed as working Saturday night. Sunday was then classed as a day off, even though that I had worked 7 hours that day.

So the final advice is..... if you don't like it this way and you can't convince your employer to come round to your way of thinking (legally or otherwise) maybe it'd be better looking for a Mon-Fri 9-5 job?

Either way you should be entitled extra pay for "unsociable hours"
