Bulk mail

By law, electronic mail is more than 50 recipients as mass mailing, even if it has no ads to content. Not every mass mail is illegal. For interest groups, there are special legal provisions. Even the massive shipment to a single recipient is considered to be mass mailing (eg, mass mailings) to several departments of a beneficiary.


Consent may be expressly granted by the future recipients, by giving a written statement.


Any (direct) Advertising in electronic communications must be labeled as such. The label may be made, for example in the subject line of an e-mail. The words can be freely chosen, but should be visible to the recipient that it is direct mail.


Under the Commercial Code (§ 14 UGB) and the Industrial Code (§ 63 GewO) have all e-mails contain an imprint. For releases that contain at least four times in a calendar year will be disseminated electronically in a similar design (eg, e-mail newsletter), directly after the media disclosed in the newsletter imprint. In addition, a disclosure in the newsletter itself or through a link has lead to a site.

In Switzerland, the sending of spam, since 1 is April 2007 is prohibited. The Telecommunications Act prohibits, under threat of fine or imprisonment, to send unsolicited via e-mail, SMS or other telecommunication channels of mass advertising, or to give such a commission. In addition, the providers and telephone companies are required to be disclosed to the extent known, names and addresses of the sender to allow the victims to file a claim.

In the United States was established by the CAN-SPAM Act, spam is prohibited in principle. Meanwhile, the first spammers have been arrested, 2004, was sentenced in the U.S., a spammer to a prison term of nine years, but not because of sending spam, but other crimes such as computer fraud or identity theft.

Australia was a pioneer in anti-spam laws, and punish spamming the first country hard. However, the government held open a loophole: party advertising is different than in Germany where E-Card ‘spam’ were permitted.

Known spammers

* Gary Thürk sent to 400 users connected to the ARPANET, 3 May 1978 the first spam.
* Vardanovich Vardan Kushnir – died on 24 July 2005. The notorious Russian spammer was found murdered in his apartment.

* James McCalla was, on 6 January 2006, { }to a compensation payment of 11.2 billion U.S. dollars to a local Internet Service Provider condemned the highest ever fine for a spammer.

* Daniel Lin: the 30-year U.S. spammer is on the 6th September 2006 in the United States to three years imprisonment and a fine of 10,000 dollars (7,500 euros) had been convicted. So, one of the first method was introduced in 2003 after the U.S. anti-spam law (Can-Spam Act) to the end.

* Robert Alan Soloway, one of the world’s biggest spammer was arrested in the U.S on 30 May 2007, for his federal crimes. Consequently, he faces a long prison sentence.

* Christopher Smith – the 27-year old was sentences a prison term in August 2007. The sentence was for 30 years. It was not for violating the CAN-SPAM Act, but because of nine other crimes.

* Sanford Wallace has been: convicted along with Walter Rines by a U.S. federal court for a compensation payment of 230 million U.S. dollars to the Internet forum operators MySpace.

Increased expenses for remedial action – on both sides

The following are the most popular action against UBE and the resulting reactions were made by the spammer with new filters and other techniques are described to avoid it. It clearly demonstrates the increased effort on both sides.

The review of the validity of sender addresses led to the use of valid addresses. This had the effect that innocent people have been inundated with thousands to millions of bounces.

The introduction of filters, the mail led to certain terms revised to mail that contained deliberate spelling mistakes (e.g., V1a9ra instead of Viagra) or with invalid HTML – the HTML mail readers will almost always ignore to perform conversion to the true content.

The spamming methods were getting better and innovative: the text from spam filters will escape the fact that advertising is-sent spam in the form of GIF images, and so cannot be easily filtered. In addition, these images through simple algorithms are modified slightly from copy to copy without compromising readability. This makes them harder to detect by a filter. Instead of pictures and PDF, the attachments come before.

Blocking of known open relays and known UBE sends the server resulted in the proliferation of Trojan horses, which the computers of regular users as UBE senders converted.

The introduction of centralized lists, information on open relays and other widely used and are increasingly used by email providers, led to denial of service attacks against the operators of the list and their respective ISPs.

It is believed that in 2003 increased emergence of worms on the spread and implementation of statistical analysis tools (e.g., due Bayesian filtering).

Some providers are starting to monitor the port 25 or not to lock it to take any existing viruses, the ability to send on this port e-mails.

New solution: replace with new SMTP mail transfer methods.

The use of new methods of transmission of mail, which allow authentication of the mail servers involved, will replace the previous system (SMTP).
